ROC Home Sale Policy
When one of your residents is selling their home in your community, the buyer of that home has the right under law to request certain information from the ROC Board of Directors before the sale is final.

N.H. Senate Bill 166
N.H. Senate Bill 166 was signed into law on July 15,2025. This bill amends NH RSA 205-A:32, and takes effect on January 1, 2026. This law impacts the sale of any home in a ROC cooperative.
As of January 1 2026, when one of your residents is selling their home in your community, the buyer of that home has the right under law to request certain information from the ROC Board of Directors before the sale is final. If the buyer makes a written request, the Board must provide the information within 10 days.
The information includes:
- Whether the home seller owes unpaid fees to the ROC.
- Planned major repairs or expenses for the next two years (Capital Improvement Plan)
- The status/balance of the Capital Reserve Fund (on the Balance Sheet)
- Last year’s Income Statement/Profit and Loss AND Balance Sheet
- Any lawsuits involving the ROC (no details, just any ongoing lawsuits)
- A copy of the ROC’s Certificate of Insurance, and whether your Community Rules require member households to retain insurance of any kind
- Statement from the board indicating whether any improvements made by the seller of the home are known to be in violation of community rules
- A copy of the ROC’s Articles of Incorporation (referred to in New Hampshire as Articles of Agreement and available at the Secretary of State’s Office, online), A copy of the Bylaws, and a copy of the Community Rules
- Current monthly lot rent and any annual fees, and any special assessments that members have paid from the past three years.
To help with this process:
- Board of Directors should be prepared to keep these documents and statements up to date and ready to share with a prospective buyer of a home when requested.
- Boards should work closely with their Property Management Company to determine how to best accommodate requests when received.
- The 10-day turnaround requirement demands that information is ready to share immediately.
